These terms and conditions of sale apply to all orders placed in the Doux Cocon shop.

Article 1: Scope

These terms apply to all orders placed on douxcocon.fr (the “Website”) by consumers, meaning natural persons buying for purposes outside their trade, business or profession. By placing an order, you confirm that you have read and accept these terms.

Article 2: Seller

Hereinafter “Doux Cocon” or “we”.

Article 3: Products

The main characteristics of each product are shown on its product page. Where an item is handmade, there may be slight differences in colour, shape or finish from one piece to another; they are part of its handcrafted character. Colours may also look slightly different depending on your screen.

Please follow the installation, use and safety instructions on the product page and the packaging.

Our products are offered while stocks last. If an ordered product is no longer available, we will let you know as soon as possible and refund you in full.

Article 4: Prices

Prices are in euros and include taxes. Standard shipping to mainland France, Belgium and the Netherlands is free. The price that applies is the price shown when you place your order.

If a product's price contains an obvious error, for example an abnormally low price caused by a typing mistake, we may cancel the order concerned; you will then be refunded in full.

Article 5: Ordering

You select your products, check your cart and the total price, confirm your order and pay. The contract is concluded when we send the order confirmation email, which we recommend you keep.

We may refuse or cancel an order in case of suspected fraud, a previous payment dispute or if the product is unavailable; you will then be refunded all amounts already paid.

Article 6: Payment

Payment is due when you place your order, using the payment methods offered at checkout, including payment card, Apple Pay, Google Pay and Bancontact. Payments are processed securely by Shopify Payments; we never have access to your full payment details.

Article 7: Delivery

We deliver to mainland France, Belgium and the Netherlands, to the address you provide when ordering. Delivery takes 8 to 14 business days from placing your order. All details are in our shipping policy.

The risk of loss of or damage to the product passes to you when you, or a third party other than the carrier and indicated by you, take physical possession of the product.

Article 8: Right of withdrawal

You have a right of withdrawal of fourteen days from receipt of the product, without giving any reason. Full information on exercising this right and the model withdrawal form are in our return and refund policy. We bear the cost of returning the goods.

Article 9: Free returns within 30 days

In addition to the statutory right of withdrawal, you can return an item free of charge up to 30 days after receipt, under the conditions described in our return and refund policy. This commercial offer is in addition to your statutory rights and does not limit them.

Article 10: Statutory guarantees

All our products are covered by the statutory guarantees. If you live in Belgium or the Netherlands, you are entitled to the statutory guarantee of conformity under the law of your country of residence.

For consumers living in France, the following mandatory information under the French Consumer Code also applies (translation; the French text in our French terms prevails):

The consumer has two years from delivery of the goods to invoke the statutory guarantee of conformity if a lack of conformity appears. During this period, the consumer only has to prove the existence of the lack of conformity, not the date on which it appeared.

Where the contract of sale provides for the continuous supply of digital content or a digital service for more than two years, the statutory guarantee applies to that digital content or service throughout the planned supply period. During this period, the consumer only has to prove the existence of the lack of conformity affecting the digital content or service, not the date on which it appeared.

The statutory guarantee of conformity obliges the seller, where applicable, to supply all updates necessary to keep the goods in conformity.

The statutory guarantee of conformity entitles the consumer to repair or replacement of the goods within thirty days of the request, free of charge and without major inconvenience.

If the goods are repaired under the statutory guarantee of conformity, the original guarantee is extended by six months.

If the consumer requests repair but the seller imposes replacement, the statutory guarantee of conformity starts again for two years from the date of replacement.

The consumer may obtain a price reduction while keeping the goods, or terminate the contract and obtain a full refund against return of the goods, if:

1° the seller refuses to repair or replace the goods;
2° repair or replacement takes place after thirty days;
3° repair or replacement causes the consumer major inconvenience, in particular where the consumer permanently bears the costs of taking back or removing the non-conforming goods, or the costs of installing the repaired or replacement goods;
4° the lack of conformity persists despite the seller's unsuccessful attempt to remedy it.

The consumer is also entitled to a price reduction or termination of the contract where the lack of conformity is so serious that an immediate price reduction or termination is justified. The consumer is then not required to request repair or replacement first.

The consumer is not entitled to terminate the sale if the lack of conformity is minor.

Any period during which the goods are unavailable for repair or replacement suspends the remaining guarantee period until the repaired goods are delivered.

These rights result from articles L. 217-1 to L. 217-32 of the French Consumer Code.

A seller who in bad faith obstructs the application of the statutory guarantee of conformity is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of average annual turnover (article L. 241-5 of the French Consumer Code).

The consumer also benefits from the statutory guarantee against hidden defects under articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund against return of the goods.

To make a guarantee claim, contact us at info@douxcocon.fr with your order number and a description of the defect, ideally with photos.

Article 11: Liability

We are responsible for the proper performance of your order. However, we are not liable for damage resulting from improper use of the product, failure to follow the installation, use or safety instructions, or force majeure. Nothing in these terms limits your rights under the statutory guarantees, or our liability for defective products or for personal injury caused by our fault.

Article 12: Force majeure

We are not liable for any delay or failure to perform caused by force majeure within the meaning of the applicable law, for example a carrier strike, a natural disaster or a pandemic. We will inform you as soon as possible. If the situation continues, you may cancel your order and receive a full refund.

Article 13: Intellectual property

The texts, photographs, logos and graphic elements on the Website are protected by intellectual property rights. Any reproduction or use without our prior written consent is prohibited.

Article 14: Personal data

We process your personal data in accordance with our privacy policy.

Article 15: Customer service and complaints

For any question or complaint, contact us at info@douxcocon.fr or +31 6 40 77 67 68. We reply within 24 to 48 business hours.

Article 16: Mediation and disputes

In case of a dispute, please contact our customer service first so we can look for a solution together. If your complaint is not resolved, you can contact the European Consumer Centre in your country of residence free of charge; it helps consumers with disputes involving a seller in another EU country. The European Commission also publishes a list of out-of-court consumer dispute resolution bodies at consumer-redress.ec.europa.eu.

Article 17: Applicable law and jurisdiction

These terms are governed by Dutch law. This choice does not deprive you of the protection of the mandatory provisions of the law of your country of residence. In case of a dispute, you may bring proceedings before the courts of your place of residence or those of the seller's place of establishment; we may only bring proceedings against you before the courts of your place of residence.

Article 18: Language

These terms are drawn up in French. Translations into Dutch and English are available on the Website.

Article 19: Changes

We may change these terms at any time. The terms that apply to your order are those in force on the date of your order.
